Marketplace Terms of Service

These Marketplace Terms of Service govern your use of the Tokyofishmarket peer-to-peer marketplace, where users can buy and sell collectible items. These terms supplement our general Terms and Conditions and apply to all marketplace participants, whether as buyers, sellers, or both.
1. Marketplace Overview
The Tokyofishmarket marketplace is a platform that connects buyers and sellers of collectible items, including anime figures, designer toys, goods, apparel, accessories, and lots. Tokyofishmarket acts as an intermediary and is not a party to the transaction between buyer and seller. However, Tokyofishmarket facilitates payment processing, provides dispute resolution, and enforces marketplace policies.
2. Seller Eligibility
To sell on the marketplace, you must submit a seller application and be approved by Tokyofishmarket. Sellers are classified as either individual (particulier) or professional (professionnel) sellers. By applying, you agree to:
- Provide accurate and complete information in your application, including business registration details if applicable.
- Maintain a Stripe account for payment processing.
- Comply with all applicable laws and regulations related to the sale of goods, including consumer protection, tax, and export laws.
- Maintain your seller profile in good standing by adhering to these terms and our general Terms and Conditions.
Tokyofishmarket reserves the right to reject applications, suspend, or terminate seller accounts at its sole discretion.
3. Listings
When creating a listing, sellers must:
- Provide accurate descriptions, conditions, and photos of the item being sold.
- Accurately represent the condition of the item using the provided condition categories: sealed, like new, good, fair, or poor.
- Set prices in one of the supported currencies (JPY, USD, or CAD).
- Not list prohibited items, including counterfeit goods, stolen property, illegal items, or items that violate third-party intellectual property rights.
- Not use misleading titles, descriptions, or images to misrepresent the item.
Listings are subject to review and may be removed if they violate these terms. Listings expire after 90 days unless renewed. Auto-publishing is available for sellers with a reputation score that meets the platform threshold. New or lower-reputation sellers may have their listings subject to manual review before publication.
4. NSFW Listings
Listings for NSFW items must be flagged as such during creation. NSFW listings are only visible to users who have opted in to view such content and meet the age requirements. Failure to properly flag NSFW content will result in listing removal and potential account action.
5. Orders and Transactions
When a buyer places an order, the following process applies:
- The seller must confirm the order within the platform-specified deadline. Failure to confirm will result in automatic cancellation.
- Once confirmed, the seller must ship the item and provide tracking information.
- Buyers may cancel an order at any time before the seller marks it as shipped.
- Each order involves a single seller. Items from multiple sellers must be placed as separate orders.
- In-order messaging is available for buyers and sellers to communicate about specific transactions.
6. Payments and Fees
All payments are processed through Stripe Connect. By using the marketplace, you agree to the following:
- Tokyofishmarket charges a platform commission on each completed transaction. The commission is deducted from the seller's payout.
- Payments are held until the transaction is complete and any claim period has expired.
- Sellers receive payouts to their Stripe account after the claim window closes.
- Buyers must complete payment at the time of order placement.
- Refunds, when applicable, are issued to the buyer's original payment method.
7. Shipping
Sellers are responsible for shipping items to buyers. The marketplace uses a flat-fee shipping model based on origin and destination zones. Sellers must:
- Ship items within the timeframe specified by the platform after order confirmation.
- Provide valid tracking information.
- Package items securely to prevent damage during transit.
Tokyofishmarket is not responsible for carrier delays, customs fees, duties, or taxes. These are the responsibility of the buyer unless otherwise stated.
8. Disputes and Incidents
If a buyer receives an item that does not match the listing description, is damaged, or is not received, they may file an incident report. The dispute resolution process works as follows:
- Buyers must file incident reports within the claim window after delivery confirmation.
- Incident reports must include a description of the issue and supporting evidence (photos or videos).
- Tokyofishmarket acts as the intermediary in all disputes. The buyer interacts exclusively with Tokyofishmarket, not directly with the seller, during the dispute process.
- After review, Tokyofishmarket will determine attribution (seller fault, carrier fault, or platform fault) and apply the appropriate resolution.
- Resolutions may include a full refund to the buyer. The cost of seller-attributable losses is borne by the seller.
9. Reputation and Trust
Tokyofishmarket operates a reputation system that evaluates both buyers and sellers based on their marketplace activity. Your reputation score is calculated from multiple signals, including order completion rate, confirmation speed, incident history, and overall platform engagement. Reputation scores determine your trust tier:
- Higher trust tiers unlock privileges such as auto-publishing of listings and increased visibility.
- Low reputation scores may result in restricted privileges, manual review requirements, or account suspension.
- Reputation scores are updated periodically and stored as snapshots for transparency.
Attempts to manipulate the reputation system through fake transactions, coordinated ratings, or other fraudulent means will result in immediate account termination.
10. Prohibited Conduct
The following conduct is prohibited on the marketplace:
- Listing counterfeit, stolen, or illegal items.
- Misrepresenting item condition, authenticity, or provenance.
- Attempting to complete transactions outside the platform to avoid fees or protections.
- Harassment or abusive communication with other marketplace participants.
- Filing fraudulent incident reports or abusing the dispute system.
- Using automated tools to create listings, place orders, or manipulate the marketplace.
- Engaging in price manipulation, shill bidding, or artificial scarcity tactics.
11. Account Suspension and Termination
Tokyofishmarket may suspend or terminate marketplace access for violations of these terms. Suspended sellers may have their active listings removed and pending payouts held pending investigation. Terminated accounts may not create new accounts without explicit written authorization from Tokyofishmarket. Blocking between users is available for fraud prevention and personal safety.
12. Limitation of Liability
Tokyofishmarket facilitates transactions but does not guarantee the quality, safety, legality, or authenticity of items listed on the marketplace. Tokyofishmarket is not liable for:
- The accuracy of seller listings or item descriptions.
- Shipping delays, losses, or damages caused by carriers.
- Disputes between buyers and sellers beyond what is covered by our dispute resolution process.
- Customs fees, duties, taxes, or regulatory compliance in the buyer's or seller's jurisdiction.
13. Intellectual Property
Sellers are solely responsible for ensuring that their listings do not infringe on the intellectual property rights of third parties. Listing photos must be original photos of the actual item being sold. The use of manufacturer stock images is permitted only to supplement original photos, not replace them. Tokyofishmarket will process DMCA takedown requests for listings that infringe on copyright in accordance with our DMCA and Copyright Policy.
14. Changes to These Terms
Tokyofishmarket reserves the right to modify these Marketplace Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the marketplace after changes are posted constitutes acceptance of the updated terms.
